The Immigration Regulations in its article 162 establishes that temporary residence permits are extinguished for the following reasons: (…) 2. The temporary residence permit will be extinguished by resolution of the competent body for its granting, in accordance with the procedures provided for in the current regulations for the procedures for granting, modifying and extinguishing permits, when the concurrence of any of the following circumstances is verified: a) When the foreigner changes or loses his nationality, without prejudice to the possibility of acquiring another residence permit in light of the new circumstances. b) When the circumstances that served as the basis for its concession disappear. c) When the serious inaccuracy of the allegations made or of the documentation provided by the holder to obtain said residence permit is verified. d) When the holder no longer possesses a valid and current passport, similar document or, where appropriate, registration card, unless the holder can justify that the necessary procedures have been carried out for the renewal or recovery of the passport or similar document. e) When staying outside Spain for more than six months in a one-year period. As you can see, the departures of all those who had a temporary residence permit were extinguished if they remained outside Spain for a period of more than six months in a year. This means that in addition to having the specific renewal requirements for each permit, the issue of departures made during said residence in Spain must also be taken into account. This article through which this type of temporary permit was extinguished has been declared null and void and therefore these permits can no longer be extinguished for this reason. SUPREME COURT RULING Yesterday, the Supreme Court issued a ruling declaring null and void the aforementioned article 162.2.e) of RD 557/2011, as it considers that it limits the fundamental right of free movement of foreign citizens with temporary residence in Spain recognized in the Spanish Constitution, specifically in its article 19.
