A presentation by Michaël Lessard and Gabriel Destrempe December 10, 2024 from 12 p.m. to 1 p.m. In 2022, the reform of the Youth Protection Act of Quebec included the interest of the child as a primary consideration in the articulation of the youth protection regime. However, the very notion of the interest of the child is not immutable. An analysis of this reform allows us to appreciate the directions that parliamentarians wanted to give to the notion of the interest of the child in the context of youth protection. As part of this lunchtime web conference, we will go through the main amendments to the Youth Protection Act and its impact on the notion of the interest of the child. We will also discuss how these amendments could percolate into the practice of family law and the assessment of the interest of the child in Quebec civil law.
