Published in 1978 by ordinance 3,214 and classified as a special standard by ordinance 787, it underwent only one change, which occurred in 1999 by ordinance 2,037 of December 15. In fact, if we look at this ordinance, it basically deals with changes to NR-22, but its text also removes several items from NR-21, making the standard very short and only two pages long for those who consult it on the Ministry of Economy website. In fact, it is a page and a half with obligations basically directed at the health and hygiene of workers (and their families in some cases). Let's look at some of these obligations, in the form of a list to keep things organized. Unhealthiness: #Controversy NR-15, which addresses unhealthy work activities and conditions, in its appendix 3 (heat), determines that there is no additional unhealthiness for activities involving exposure to heat from a natural source. In other words, outdoor work with exposure to sunlight does not give rise to the aforementioned additional payment, despite there being case law granting it. The other possibility regarding the additional payment for unhealthiness is in appendix 7 of NR-15: non-ionizing radiation, which considers ultraviolet radiation (UVa and UVb rays emitted by the sun) for the purposes of unhealthiness. However, according to the aforementioned appendix, to characterize an unhealthy activity, the exposure must be without adequate protection and proven by means of an inspection report carried out at the workplace. As we said at the beginning, NR-21 is quite short and we do not have much to address, since it is quite direct and basically refers to the comfort conditions of workers. However, it is worth mentioning that there are a huge number of professionals performing this type of work, outdoors. We need to enforce this standard and provide decent and dignified working conditions to those who are exposed to the activities included in this context.
