Article 445 of the 2002 Civil Code establishes two distinct time limits for the purchaser of an asset affected by a redhibitory defect to exercise his right to the guarantee; one of them is provided for in the caput of the provision, and the other in its first paragraph. How are these time limits related? In this video, Professor Daniel Carnaúba answers this question by demonstrating that the article, in fact, regulates two different institutes: the guarantee period and the claim period. -------------------------------------------------------------------- Prof. DANIEL AMARAL CARNAÚBA Adjunct Professor of Civil Law at UFJF-GV PhD in Civil Law from the USP Law School Master in Private Law from the Sorbonne Law School (Paris 1) Lattes: http://lattes.cnpq.br/2920880373440295 -------------------------------------------------------------------- CONTEMPORARY CIVIL LAW NETWORK Founded in 2014, the Contemporary Civil Law Network – RDCC – is a research institution that brings together several national and foreign universities with the objective of developing investigations, events and publications of legislative and jurisprudential interest in the field of Civil Law.
