Right hand possession is a contract between free people based on sex only (cohabitation, customary, pleasure, friend) all of which fall under the category of right hand possession since it is a voluntary relationship. Written by Muhammad Shahrour 🖋: God Almighty said {And those who guard their private parts, Except from their wives or those their right hands possess, for indeed, they are not blameworthy. But whoever seeks beyond that, then those are the transgressors. (Al-Ma'arij -29-30 - (31) We understand from the Almighty's saying that the sexual relationship between a man and a woman can only be in one of these two cases, i.e. the first case is marriage and the second case is right hand possession, and right hand possession is mentioned 14 times in the Holy Qur’an). The right hand belongs to the male and the female. The male can have a female right hand, and the female can have a male right hand. The right hand is not marriage, and marriage is not the right hand. Any other case other than that is a transgression against the sanctities of God, as He says: “But whoever seeks beyond that - then those are the transgressors.” From here you are trying to discuss a hadith mentioned in Sahih Al-Bukhari, knowing that we consider all books of hadith to be historical documents and not religious documents, like the books of the biography of the Prophet, and we want to discuss the following hadith as a historical document that does not carry any sanctity: It was mentioned in Sahih Al-Bukhari, Book of Marriage 4827: (Ali told us, Sufyan told us, Amr said, on the authority of Al-Hasan bin Muhammad, on the authority of Jabir bin Abdullah and Salamah bin Al-Akwa’, they said: We were in an army and the Messenger of the Messenger of God, may God bless him and grant him peace, came to us and said: He has given you permission to enjoy yourself, so enjoy yourself. And Ibn Abi Tha’lab said: Iyas bin Salamah bin Al-Akwa’ told me, on the authority of his father, on the authority of the Messenger of God, may God bless him and grant him peace: Any man and woman who agree, then they should spend three nights between them. If they like to increase or leave each other, then they leave each other. I do not know if it was something that was for us specifically or for the people in general. Abu Abdullah said, and Ali explained it from the Prophet, may God bless him and grant him peace, that it was abrogated. End. The first thing that draws attention in this hadith is whether it speaks about a state of marriage or a state of right-hand possession? Or did the Prophet create a state that is not marriage or right-hand possession? And it applies to whoever seeks beyond that, then those are the transgressors. So if it was marriage or right hand possession, why was it abrogated? The distinctive thing in this hadith is a voluntary relationship that may be temporary between a man and a woman, and since it is voluntary, both are free. Our jurists are accustomed to the idea that right hand possession is between a free man and a slave, and it is established in their understanding that right hand possession can only be by force, such as captivity and then buying and selling, and this is what ISIS is doing to the Yazidi women in Iraq, having sex with them on the basis of right hand possession. As for an adult, sane man agreeing with an adult, sane woman to have sex of their own free will, according to our jurists, the throne of the Most Merciful would shake with anger at this act. How can a woman choose to have sex with a man? Did the jurists realize that the Prophet (may God forbid that he transgresses the limits of God and commands what is forbidden) transgressed the limits of God, so they abrogated this hadith? If the Prophet did not transgress the limits of Allah, then this means that it was a case of right hand possession between a free man and a free woman, and it is still in effect today, as right hand possession has many cases and this is one of them. Marriage has only one form, but right hand possession has many forms, the most important of which is that a woman can be the right hand of a man or a man can be the right hand of a woman. The Prophet had wives and right hands as well. Can the honorable jurists teach us who the Prophet’s wives were and who were his right hands? The woman who gave herself to the Prophet was not one of his wives, she was free, not a slave, not a captive, and she did not come from the slave market, but rather she was his right hand possession, meaning that she gave herself of her own free will. That is, the right hand of the king can only be by the will of the woman and the man, and in our inherited culture we are accustomed to the idea that the right hand of the king is a woman who is not free and there is no objection to buying her, selling her, having sex with her, and considering her as a thing regardless of her will, and to this day we hear that the state somewhere attacks free women, and are there women who are not free slaves so that attacking them is not forbidden? This term has not been corrected to this day, and today all women are free, or at least that is how they should be. And whoever comments and asks me: Would you accept her for your sister or daughter? My answer to him: My daughter or sister is a rational, adult, free woman who has a free will, and I do not own her so I cannot answer his question, but if he asks me about borrowing my car, I can answer him yes or no, because I own it.
