The definition of what a Consortium is is given by the Civil Code which, in Article 2602, defines: "With the consortium contract, several entrepreneurs establish a common organization for the regulation or for the performance of certain phases of their respective businesses". In essence, it is an institution that allows businesses, of an economic nature, to unite and collaborate to operate better on the market, following common objectives and purposes, and maximizing results. Each business therefore retains its own identity and individuality, but some phases of the production process are governed by the common rules of the consortium. The participants in a consortium are businesses and entrepreneurs who carry out the same activity or related activities. This is the case of agricultural consortia which are made up of entrepreneurs who operate in the same sector of activity. However, there may also be mixed consortia that involve, in addition to businesses, public and private entities, such as trade associations or chambers of commerce. The consortium falls in all respects into the category of "multilateral contracts with common purpose", that is, contracts with multiple parties that together pursue a common objective, shared and established from the beginning. For this reason, organization and form are regulated by the civil code which also establishes typologies and functioning.
