The year 2024 at the Federal Supreme Court (STF) began with the expectation of a controversy-free agenda. As the months went by, the scenario took on new contours, topics such as the decriminalization of possession of marijuana for personal consumption and police approach were brought to the plenary, but can we say that they were the Court's hallmark this year? It is with a focus on elaborating what characterizes the STF of 2024 that the Sem Precedentes team leads the debate in this last episode of the year. In addition to topics that marked 2024, JOTA's podcast on the Supreme Court and the Constitution brings to the conversation a more general view of the Court's conduct, with a nod to conservatism, a clearer conversation with society and a more conciliatory stance. Luiz Fernando Esteves, a member of the Sem Precedentes permanent team, a professor at Insper and a doctor in State Law, believes that the Supreme Court has been more conciliatory and “less decision-making perhaps”. Examples of conciliation include lawsuits on indigenous rights, secret budgets, fires and medicines. The list also includes the case of the payroll tax exemption, which, although not a conciliation along the lines of the Supreme Court, led to an alignment between the branches of government. Regarding fundamental rights, the Sem Precedentes team believes that the Court made strong statements, but avoided using the same assertiveness when making decisions. One example is the ruling on the decriminalization of drug possession, in which the STF defined quantities, but when deciding, it restricted itself to marijuana. This ruling is also cited as an example of how the Supreme Court has come to perceive the context in which it operates and how this affects the scope of its decisions. While in 2015, there was a debate about the legalization of all drugs, in 2024, the president of the Court, Minister Luís Roberto Barroso, asked to speak to explain to society exactly what was being judged.
