How do we know if we meet the requirements for Spanish nationality? Take note! We explain it to you in these simple steps! COMPLY WITH THE REQUIRED LEGAL RESIDENCE PERIODS The general assumption to be able to apply for Spanish nationality by residence is when we can prove 10 years of legal and continuous residence in Spain, immediately prior to the application. Likewise, Spanish nationality can be requested with only 5 years of residence in Spain in cases where the applicant has obtained refugee status in Spain. In the case of nationals of origin from Ibero-American countries, Andorra, the Philippines, Equatorial Guinea or Portugal or Sephardic Jews, they can apply for Spanish nationality when they complete two years of legal and continuous residence in Spain, and immediately prior to the request. However, if we find ourselves in any of the situations mentioned in article 22 of our Civil Code, a one-year residence period will be enough to be able to submit our application (See here). Therefore, depending on our nationality of origin, or if we find ourselves in any of the situations contemplated by our regulations, we must comply with certain periods of legal residence in Spain prior to submitting our application. And this is the most important requirement when we want to apply for Spanish nationality by residence. IMPORTANT NOTE!: The residence must be continuous and immediately prior to submitting the application. At this point we remind you that the time as a student (with a study visa) does not count for nationality purposes, that is, the periods are counted from when we acquired the status of legal residents in Spain. TAKE THE SPANISH NATIONALITY EXAMS Another of the requirements to be able to apply for Spanish nationality is to prove that you have "a sufficient degree of integration into Spanish society", but how do we do it? In the past, it was the Civil Registry officers themselves who, based on their own criteria, conducted a personal interview with the interested parties to determine whether or not they met the integration requirement. With the current nationality process, it is necessary to take a constitutional and sociocultural knowledge test known as the CCSE and another DELE A2 language test for applicants who do not have Spanish as their mother tongue. NO CRIMINAL RECORD. Proving “good civic conduct” is another of the requirements that legal residents in Spain who want to apply for Spanish nationality must meet. But what does it mean to have good civic conduct? How is it proven? Although “good civic conduct” is an indeterminate legal concept that must be assessed by the Administration, in practice “bad civic conduct” is mainly identified with police or criminal problems. That is to say, those people who have had problems with the law, who currently have a criminal record in Spain or in their countries of origin, will most likely see their nationality denied due to this lack of good civic conduct. Those who have had a police record or a police altercation that has been reflected in a police record will be able to... ... Read the full story at: https://www.parainmigrantes.info/requ...
