Access to compulsory basic education is a subjective public right, and any citizen, group of citizens, community association, union organization, class entity or other legally constituted entity, and also the Public Prosecutor's Office, may call on the public authorities to demand it. § 1. The public authorities, within the sphere of their federative competence, must: I - annually census children and adolescents of school age, as well as young people and adults who have not completed basic education; II - make a public call for them; III - ensure, together with parents or guardians, their attendance at school. IV - disclose the waiting list for vacancies in basic education establishments in its network, including daycare centers, in order of placement and, whenever possible, by school unit, as well as disclose the criteria for preparing the list. V – guarantee parents, guardians and students access to the results of quality and academic performance assessments in educational institutions, carried out directly by the government or in partnership with international organizations. § 2 In all administrative spheres, the Government shall ensure, first and foremost, access to compulsory education, in accordance with this article, and then consider other levels and types of education, in accordance with constitutional and legal priorities. § 3 Any of the parties mentioned in the caput of this article has standing to petition the Judiciary, in the event of § 2 of art. 208 of the Federal Constitution, and the corresponding legal action shall be free of charge and subject to summary procedure. § 4 If negligence on the part of the competent authority in ensuring the provision of compulsory education is proven, it may be charged with a crime of liability. § 5 In order to ensure compliance with compulsory education, the Government shall create alternative forms of access to the different levels of education, regardless of previous schooling. Art. 6. It is the duty of parents or guardians to enroll children in basic education from the age of 4 (four). Art. 7. Education is free to private initiative, provided the following conditions are met: I - compliance with the general standards of national education and the respective education system; II - authorization of operation and quality assessment by the Government; III - capacity for self-financing, except as provided for in art. 213 of the Federal Constitution. Art. 7-A The student regularly enrolled in a public or private educational institution, at any level, is guaranteed, in the exercise of freedom of conscience and belief, the right, upon prior and justified request, to be absent from a test or class scheduled for a day on which, according to the precepts of his/her religion, the exercise of such activities is prohibited, and must be granted, at the discretion of the institution and at no cost to the student, one of the following alternative services, under the terms of item VIII of the caput of art. 5th of the Federal Constitution: I - make-up test or class, as the case may be, to be held on an alternative date, during the student's study period or at another time scheduled with his/her express consent; II - written work or another type of research activity, with the theme, objective and delivery date defined by the educational institution. § 1º The alternative provision must observe the curricular parameters and the lesson plan for the day of the student's absence. § 2º Compliance with the forms of alternative provision referred to in this article will replace the original obligation for all purposes, including regularization of the attendance record. § 3º Educational institutions will progressively implement, within 2 (two) years, the measures and adaptations necessary to adapt their operations to the measures provided for in this article. § 4º The provisions of this article do not apply to military education referred to in art. 83 of this Law.
