Their fate will be defined in one of the most important trials of the Supreme Court, will have general repercussions and will define the future of the demarcation of indigenous lands in Brazil. The process that motivated the discussion deals with the dispute over the possession of the Ibirama-Laklanõ Indigenous Land, in Santa Catarina. According to farmers, the area was not occupied by indigenous people on October 5, 1988. The Temporal Framework thesis states that only communities that occupied indigenous lands on the date of the promulgation of the Citizen Constitution: October 5, 1988 can claim indigenous lands. After decades of persecution and killings, the Xokleng forced the group to leave the territory that they are now trying to retake.
