Description of the Training: Class actions are a formidable tool for access to justice. Although they are in principle available in all areas of civil law, they cannot be brought when the dispute falls exclusively within the jurisdiction of an administrative tribunal. The objective of this presentation is to examine this limitation, its consequences and some potential reforms, using cases relating to residential leases as an example. The presentation will be divided into three parts. The first part will explain the rules of law that make class action unavailable when an administrative court has exclusive jurisdiction over the dispute. The second part will look at the consequences that flow from this limitation. Finally, the third part will explore some potential reforms that would rectify the situation by drawing inspiration from solutions adopted by other jurisdictions.
