The objective of this Law is social inclusion and the right to citizenship. The focus is to enable the full civil capacity of persons with disabilities. It is important to emphasize that the Statute of Persons with Disabilities is based on the 2006 United Nations (UN) International Convention on the Rights of Persons with Disabilities. A person with a disability is considered to be someone who has a long-term impediment, whether physical, mental, intellectual or sensory in nature, which, in interaction with one (or more) barriers, may obstruct their full and effective participation in society, on an equal basis with other people. The first articles introduce the concept of a person with a disability, which involves limitations associated with barriers, the forms of assessment of all types of disability, equality, non-discrimination and details about priority care. When necessary, a biopsychosocial assessment can be carried out. This act, which is commonly carried out within the scope of interdiction actions. The law also speaks extensively about accessibility. Making accessible means making the enjoyment of rights effective. For the inclusion of people with disabilities, there is a determination for public properties and spaces, in addition to private spaces for collective use. The law also speaks about universal design, which is the process of creating products that are accessible to all people. The law also addresses crimes committed against people due to their disability. As for civil capacity, instead of being treated as incapable, people with disabilities are considered fully capable of performing acts of civil life. Article 116 of the Statute amended the Civil Code, to which Article 1,783-A was added, which addresses supported decision-making.
