The procedure for the rapid prosecution of certain crimes is regulated in articles 795 to 803 of the LECrim. In accordance with art 795 LECrim this procedure will be applied when the following requirements are met: a) The crimes must be punished by: • A prison sentence not exceeding 5 years. • Any other sentences, whether single, joint or alternative, whose duration does not exceed 10 years, regardless of their amount. b) The criminal proceedings must have been initiated by means of a police report. c) The judicial police must: • Have arrested a person and placed him at the disposal of the court on duty, or • Have summoned a person, without arresting him, to appear before the court on duty as a defendant in the police report. d) In addition, any of the following circumstances must occur: 1st That they are flagrant crimes. 2nd That they are one of the crimes provided for in the law. 3. That it is a punishable offence whose investigation is presumed to be simple. This procedure will not apply to the investigation and prosecution of those offences that are connected to another or other offences not included in the previous section. This procedure will not apply in those cases where it is appropriate to agree to the confidentiality of the proceedings in accordance with the provisions of article 302 of the Criminal Procedure Act.
