This third sequence of the cycle on restorative justice focuses on the role of lawyers and magistrates. While the low development of restorative justice is often attributed to the reluctance of legal professionals, who discuss its principles or fear an encroachment on their skills, it must be recognized that the latter are destabilized by this process which does not fit well into the architecture of the criminal trial. There is no market for restorative justice as there is a market for amicable settlements and restorative justice does not fit into a policy of flow management. How then can we conceive of the role of legal and justice professionals in proposing the use of restorative justice and supporting perpetrators and victims? It is to this question that Julie Couturier, President of the National Council of Bars, and Claire Strugala, Magistrate, Project Manager at the General Secretariat of the Ministry of Justice, have provided the beginnings of an answer that has yet to be constructed. A debate prepared and hosted by Soraya Amrani Mekki, Professor at the Sciences Po Law School, and Sandrine Lefranc, Research Director at the CNRS, member of the Center for European Studies and Comparative Politics (CEE), which was held at Sciences Po on November 26, 2024.
