Check out the link: https://bit.ly/comunidade-12 Provisional injunctions are procedural instruments provided for in the Brazilian Code of Civil Procedure, used to grant part or all of the practical effect of a final decision in advance or to ensure the useful result of the process. They are divided into two main categories: urgent injunction and evidentiary injunction. Urgent injunction may be requested when there are elements that demonstrate the probability of the right and the risk of damage or the risk to the useful result of the process. This injunction may be anticipated, granted before the final judgment to ensure that the effects of the decision are useful, or precautionary, which aims to ensure that the main process is not compromised by a factual or legal situation. On the other hand, evidentiary protection does not require demonstration of danger of harm or risk to the useful outcome of the proceedings and may be granted based on clear evidence of the alleged right, such as in cases of abuse of the right to defense or when the allegation of fact can be proven only by documents. Provisional protections are essential for the effectiveness of the proceedings, as they allow a quick judicial response in situations where waiting for the normal course of the proceedings could result in irreparable damage or in the ineffectiveness of the final decision.
