The Administrative Misconduct Law is required in the vast majority of public examinations, being included in the Administrative Law discipline. But how has it changed after the recent changes? How can it be required in examinations or in the OAB exam? Today I will bring a summary of the Administrative Misconduct Law, or law no. 8,429, with its updates. What is administrative misconduct? Administrative misconduct is an inappropriate and violative attitude taken by a public agent. These actions may cause harm to the State, or illicit enrichment, or violation of the principles of Public Administration. The Administrative Misconduct Law defines “Public Agent” in a broad way, going far beyond just the effective public servant. The second important point is that administrative misconduct, in itself, is not considered a crime, even though it is an illegal and violative act; rather, it is conduct of a civil nature. However, it is possible to be convicted in the criminal sphere for crimes against public administration. While administrative misconduct actions are processed in the civil sphere, crimes against public administration belong to the criminal sphere, and in this case the procedures and sanctions will be different. In this video, I will also talk about the most important classification brought by the Administrative Misconduct Law, which is the one that divides administrative misconduct actions into: illicit enrichment, damage to the public treasury and violation of the principles of public administration. Illicit enrichment is classified when the public agent uses his/her position and powers to obtain economic advantage for his/her own benefit or for another person, in an undue manner. Damage to the public treasury is that which causes loss of financial resources of the Public Authority. Violation of the principles of public administration would be actions that violate the duties of honesty, impartiality and legality. I will also talk about the main changes in the law, especially the most recent changes (which are more likely to be included in tests).
