In September 2003, Christophe DALMASSO, a 34-year-old businessman from Nice, disappeared, leaving behind only the wreckage of his burnt-out car. Later, bones were found on the shore of Golfe-Juan in 2004. That's when an investigation was opened to find Mr. DALMASSO's murderer. Indicted by a judge in Nice, Miss Lucie DALMASSO was twice suspected of being the instigator of her father's murder, with her boyfriend at the time, Edno BORBA DA SILVA, as her armed wing. Imprisoned in 2005, she was finally cleared on June 30, 2012. Indeed, after 8 years of investigation, Lucie DALMASSO, defended by Maître Sylvie Noachovitch, was exonerated and thus benefited consecutively from two orders of dismissal issued by the Aix en Provence investigating chamber confirmed by the Court of Cassation, now final. BORBA DA SILVA, described by experts as a pervert and a fabulist, had denounced her as being the instigator of the murder. According to him, he would have committed the murder under her orders to allow her to collect a colossal inheritance. Christophe DALMASSO's mother has relentlessly tried during these 8 years of proceedings to overwhelm Miss Lucie DALMASSO and to denounce her, including in front of the media, as the instigator of her son's murder, despite two decisions of dismissal which completely cleared her. Maître Sylvie Noachovitch defended Miss DALMASSO during all these years with the deep conviction of her client's innocence and has never left room for doubt. She has never understood this relentlessness of which Miss Dalmasso was the victim. These orders of dismissal are the culmination of a strong fight against the risk of miscarriage of justice. In 2009, the Assize Court of Nice was called upon to judge Edno Borba DA SILVA, the alleged murderer of Christophe DALMASSO. It emerged from this hearing that the body of Christophe DALMASSO was cut up and then put in garbage bags before being thrown into a ravine used as a dump by the surrounding residents. The name of another person who had participated in the transport of the body then emerged, that of Wissem KRAIEM, a friend of Edno BORBA DA SILVA. Additional information was immediately ordered and Mrs. BONNICI, Investigating Judge, was appointed. During this period of time, Edno BORBA, who was released under judicial supervision by the Assize Court in 2009, fled to Brazil where he is still hiding. On March 21, 2013, the Assize Court of Nice welcomed Lucie DALMASSO's constitution as a civil party and awarded her the sum of 1 euro in damages that she was requesting as well as the sum of 3,000 euros under Article 375 CPP. Mr. Edno BORBA DA SILVA was sentenced to life imprisonment and Mr. WISSEM KRAIEM to seven years of imprisonment. The Assize Court thus exceeded the demands of the Attorney General, which were 30 years for BORBA DA SILVA and 2 years for Wissem KRAIEM. Having emerged completely cleared of this affair and finally recognized as a victim after eight years of struggle, Miss Lucie DALMASSO will now have to rebuild herself and regain her rights, such as that of inheriting from her father in the same way as her uncle. In accordance with the Franco-Brazilian convention, a new trial will have to be opened in Brazil so that Edno BORBA DA SILVA can actually serve his sentence.
