The CLT, in article 71, states that in all work that lasts more than six hours, it will be mandatory to grant a break for rest and food with a minimum duration of one hour and a maximum of two hours. In a few exceptions, a break longer than two hours will be possible. Note that when the CLT says that this granting of the break is mandatory, it is referring to the employer. It is the employer who has the obligation to ensure that this rule is complied with and, consequently, if there is non-compliance, it is the employer who must be held responsible. In the same article of the CLT, number 71, it is also stated that if the working day is less than six hours and more than four hours, the break must be at least fifteen minutes long. Folks, another very important thing that the CLT says, in article 71, is that if the employer does not grant a break or grants less than the CLT determines, this employer is obliged to pay the worker compensation with an amount equal to the time that was reduced from the break plus an increase of fifty percent. This compensation, or indemnity, is made in cash because it is not possible to go back in time and give the worker back the minutes that were excluded from his break. What can be done is to pay this amount in cash. Furthermore, if the break time does not count as working time because during the break the worker is free to do whatever he wants, when the break is reduced, this means that the time that the worker worked must, logically, be included in the working day. The consequence of this will be that the employee will be working extra minutes, and therefore will ALSO be entitled to receive these thirty minutes as overtime. All employees, anywhere in Brazil, are entitled to a break, as long as they work more than four continuous hours. Those who work from four to six hours are entitled to a fifteen-minute break, and those who work more than six hours a day will be entitled to a minimum break of one hour and a maximum of two hours. In short, to know if an employee is entitled to a break during the workday, just check the number of hours he or she works per day. It is very important to understand that the break must be a mandatory break from professional activities to avoid the wear and tear and fatigue of many consecutive hours of work.
