This concept is fundamental to understanding how legal proceedings work when there is more than one person involved on the same side of the action, either as plaintiff or defendant. Litisconsortium occurs when, in a single legal action, there is the participation of several people in the active pole (the plaintiffs), in the passive pole (the defendants), or on both sides. This means that two or more people are together (procedurally speaking), either defending a common cause or responding to a lawsuit. I will talk about joinder of parties, in a very easy-to-understand explanation. There are different types of joinder of parties, and each one has its own particularities. I will start by talking about optional joinder of parties and necessary joinder of parties. In optional joinder of parties, the presence of more than one plaintiff or more than one defendant in the lawsuit is an option, not an obligation. In necessary joinder of parties, the presence of all joint parties is essential for the validity of the lawsuit. While in simple joinder of parties the joining of parties is optional, in necessary joinder of parties, the presence of all parties is mandatory. Joinder of parties can also be classified according to its formation. It can be unitary or simple. Joinder of parties is unitary when the judge's decision must be the same for all joint parties. This means that the judge cannot issue different sentences for the different participants in the joint litigation.
