By right of blood or 'ius sanguinis'. 2. By marriage. 3. If, for example, your great-grandfather is Italian but your grandmother died without being recognized, this does not affect the process at all. ------------------------------------------- TRIAL BY MATERNAL LINE ------------------------------------------- One of the most frequent problems when processing Italian citizenship has to do with an old law that involves women. The civil code of the Kingdom of Italy stated that only men had the right to transmit citizenship to their descendants. For that reason, if a woman married a foreigner, her children would not be Italian. In 1946, Italy became a republic and the 1948 constitution recognized the right of women to transmit citizenship to their children. What does this mean in practice? Let's see it with an example. Giuseppe was born in Italy in 1888 and is the first Italian in the family line. In 1916, his daughter Giulia was born. Since Giuseppe is a man, there is nothing to worry about. Giulia (the first woman in the family line) has two sons, Donato born in 1933 and Francisco in 1950. Since Donato was born when his mother did not have the right to transmit citizenship, by default he acquires his father's citizenship. For his part, Francisco is protected by the 1948 law and can request recognition of Italian citizenship as well as all his descendants, children, grandchildren, great-grandchildren, great-grandchildren, etc. If your case is like Donato's, it DOES NOT MEAN that you cannot obtain citizenship, you will simply have to process it through judicial means instead of administratively. ----------------------------------------------- HOW DO I PUT THE FILE TOGETHER? ----------------------------------------------- You will need: 1. Birth, marriage and death certificates from the Italian to you in a direct line.
