A hill tribe woman with cancer who cannot read was tricked into signing loan documents for almost 20 years, resulting in nearly 300,000 baht in debt but never having spent a single baht. When she went to ask at the bank, they chased her away, calling her crazy. She was extremely stressed and afraid that if she died, the debt would be passed on to her children. A representative from the Lawyers Council under Royal Patronage met with Mr. Chan (alias), 64 years old, and Mrs. Mee (alias), 57 years old, villagers of Ban Sop Huai Fan, Bo Kaew Subdistrict, Samoeng District, Chiang Mai Province, after relatives contacted her for help. Mrs. Mee was tricked into signing loan documents from a bank at the Samoeng District branch since 2009. She has accumulated a total debt of 270,990,861 baht and 50 satang, which Mrs. Mee has never spent a single baht. Mrs. Mee said that she and her husband cannot read and live with their mentally unstable child, while the other two children work in other provinces. Before the incident, her husband and five friends in the group applied for loans from a bank as members of a group loan program, guaranteeing each other. Causing her husband to owe the bank 20,000 baht. But when the debt payment date came, her husband had no money to pay. So the group leader paid the 20,000 baht first. Then her husband borrowed another 30,000 baht from the bank and returned 20,000 baht including interest to the group leader. After 2-3 days, the group leader came to the house and talked about the help he had given her and informed her that he would remove her husband’s name from the bank’s membership account and let him be a member instead. Then in 2009, a bank officer came to the house and asked for a copy of his house registration and ID card to open a bank account, 200 baht. She said she did not have the money, but the officer said it was okay. After 2-3 days, the bank officer came to ask her to sign a loan document, which she refused. But the officer claimed that he would lend her 5,000 baht and told her to sign the documents and receive the money later. But when the time came, she did not receive the money. Then in 2013, she got cancer and had to undergo surgery and recuperate for several years before she later found out that Someone gave me 3 bankbooks, stating that I owed the bank 150,000 baht, so I went to file a petition for justice at the Damrongtham Center, Samoeng District in December 2018, but there was no progress. During that time, I continued to receive debt notification letters from the bank, so I was worried and went to file a complaint at the Bo Kaew Subdistrict Administrative Organization. The Subdistrict Administrative Organization forwarded the case to the Chiang Mai Provincial Justice Office, but the case went quiet. So I went to the Chiang Mai Provincial Justice Office on May 14, 2021 to follow up on the progress. The officer said that there was no lawsuit from the bank at this time. From now on, I don't have to sign any documents from the bank. However, I still received many documents from the bank, but I couldn't read them, so I asked my children to read them for me. They were debt payment allocation documents and invoices. I felt uncomfortable and didn't know what to do next. Most importantly, I had never used a single baht of the loan. After that, I went to the bank several times to ask for the facts. The officer said that he would make the debt zero. Sometimes, I was fired from the bank, saying that if I received a debt notification letter, I should tear it up. If I couldn't tear it up, he would help me tear it up. Before being fired from the bank Accused of being crazy Until in 2024, I was contacted by the bank that the group of people whose names were listed as guarantors for the loan came to give me conditions to sign a document. If I agreed to sign, the debt would become zero debt. But I refused. Most recently, in June, the bank sent a letter stating that I had total debts including interest of 270,9861 baht and 50 satang. This caused me a lot of discomfort because now I am old and have to take care of my mentally unstable children. I earn income from farming, gardening, and weaving. I have no way to find money to pay off this debt. I am afraid that if I leave this world, I will leave the debt for my 3 children. Mr. Top, a pseudonym, the child of the victim, revealed that after learning about the incident, he tried to help his mother because both his father and mother could not read but could only write their own names. From observing the 3 bank accounts that he received after going to an unknown location for many years The first passbook on the list stated that on 23/03/09, 200 baht was deposited to open an account. Then on 19/05/09, 150,000 baht was deposited into the account and 150,000 was withdrawn. Then, 2,000 baht was deposited on the same day. After that, there were no details. As for the second and third bank accounts, it is expected that the passbooks were replaced with the first one because the details of the money are linked. However, there were deposits of 3-4,000 baht at a time and immediate withdrawals several times. It is expected that someone paid the installments until later there were no deposits at all until the bank issued a letter notifying them of the debt.
