About :

Hearing for the protection of rights, also known as judicial control, carried out as legal advisor with my boss, father and lawyer Martín Márquez Carpio. Guadalajara, Jalisco, Mexico, October 2020. In this hearing we fought terrible omissions by the Prosecutor's Office to the detriment of a victim whose leg was amputated due to traffic accidents. Despite the harm suffered in the presumably criminal act, the Prosecutor's Office acted behind her back in returning the trailer that amputated her leg, without having notified her of this situation despite the fact that this is her right. Currently we continue to expect that the matter can be resolved through an alternative route, in talks with the insurance company, waiting for a fair proposal in favor of the interests of the victim, which can compensate to some extent for the damage caused to her. In Mexico, many people claim that with the new criminal system, victims cannot defend their rights. That is wrong. Victims can go before a Control Judge to defend their rights. Victims have the right to actively participate in the criminal procedure, and the Prosecutor's Office is obliged to respect their human rights. Notifying victims of the Prosecutor's Office's actions is not a favor or optional, it is an obligation of the Prosecutor's Office, correlated with the victims' right to justice.
