In this webinar, we focus on summarizing and explaining the key aspects of the changes to the Labor Code regarding sobriety tests for employees, which came into force over half a year ago. We discuss when and under what circumstances an employer may conduct sobriety tests and whether introducing appropriate provisions into the Work Regulations is mandatory. During the session, we analyze two main types of tests: preventive and ad hoc, explaining their application, legal framework and procedures. We also deal with the topic of introducing preventive control procedures, discussing what provisions should be included in the work regulations. We also raise important issues such as the procedure in the event of an employee refusing to undergo a test and the interpretation of test results in the context of allowing employees to work. Additionally, we consider the specifics of sobriety tests in the case of remote work and draw attention to the employer's obligations related to the processing of personal data when conducting such tests.
