#KancelariaTransportowaKOBEN #AkademiaKOBEN #KOBENszkolenia By its judgment of 4 October 2024, the CJEU ruled on the combined complaints of Member States, including the Republic of Poland, regarding the most problematic and disadvantageous solutions for carriers implemented under the Mobility Package. The proceedings concerned, among others, the obligation of vehicles used in international transport to return every eight weeks to the operating base located in the Member State where the transport undertaking is headquartered. During the training, we will discuss the following topics: regulations that are the subject of the complaint by EU Member States, finding that the obligation to return to the base every 8 weeks is invalid, justification for maintaining in force the remaining provisions that are the subject of the complaint, consequences of the CJEU ruling for EU carriers, future proceedings for the refund of penalties imposed under the invalidated provision.
