The administrative court in Schleswig (Schleswig-Holstein) has decided that a decision by the state data protection authority (the decision and judgment are, in the eyes of the channel operator, contradictory in terms of form and content, unclear and massively incorrect) is legal. This means that all videos must be checked and almost all of them edited and all people and all license plates removed or made unrecognizable. YouTube does not offer a tool to do this automatically in a presentable form for videos that have already been published. A single point editing and review of each video would take around 1 hour to 2 days per video (depending on the length of the video and content). This would mean that the channel operator would be busy for the rest of his life (and beyond) making license plates and people unrecognizable one by one. Here you can see the result of the authority's decision and the court decision (or almost nothing at all). YouTube's anonymization tool works excellently as a complete tool. The GDPR bar is now the new video standard! The channel operator has expressly pointed out to the authorities and the court that it will be impossible to retrospectively edit the license plates in a way that is appropriate to the content and that this would lead to deletion or, as in this case, to the practically complete destruction of the essential content. AI-automated editing of the videos BEFORE publication is also not economically feasible, as this also takes an increased amount of time and must also be secure in order to avoid collecting tens of thousands of euros in possible fines. No automated plug-in is known for the channel operator's editing program. The editing software would therefore have to be changed (in some cases completely new training, higher price) and a plug-in would have to be purchased separately. The prices and effort involved are completely uneconomical for this channel and therefore not feasible, mind you only for newly created videos. The authorities also demand that all persons be made unrecognizable, as they could also be recognized, for example, by the clothing they are wearing or objects they are carrying. The channel operator is not aware of any automatic AI tool that can do this. So far, these have only been limited to the face or head area. Apart from the lack of economic viability, there is also the automated technical impossibility. The data protection authority in Kiel and the court in Schleswig are therefore demanding things that are completely unreasonable and therefore completely unrealistic and technically not economically feasible today (August/September 2024). It should be noted that the authority's decision was issued in 2020, at that time nothing was known about AI in widespread use. Since this video also took a lot of work to edit and it cannot be assumed that it will be appealing enough to attract many viewers, this is one of only a few videos and is therefore only for demonstration purposes.
