Attention! Your dismissal may have been fraudulent. The Superior Labor Court (TST) periodically publishes a ranking of the topics that are most frequently the subject of labor lawsuits. Among labor lawsuits, the most frequent topic is advance notice, more specifically retroactive advance notice. Advance notice is a period of at least 30 days that every employee is entitled to before leaving the company. It is the communication about the termination of the employment contract (dismissal). The employee will have 30 days to prepare until he or she is completely terminated from his or her employment relationship. Advance notice can be compensated or worked: Compensated notice: when the employee no longer needs to return to work and receives compensation of at least one salary, if he or she has worked for less than 1 year, or the amount corresponding to up to 90 days of work, counting one additional day in the notice (more than 30 days) for each year worked. Worked notice can occur in two ways: 1. The employee can be absent for 7 days; 2. The worker works for 1 month on a reduced working day of 2 hours. It turns out that many workers are dismissed without giving prior notice or receiving compensation. These are fraudulent terminations, in which the employer declares in the Employment Contract Termination Agreement (TRCT) that the notice was given 30 days before the date of dismissal, when this was not the case. The worker signs the TRCT and does not realize the fraud. This type of fraud is known as: retroactive prior notice.
