Private sellers can exclude the statutory liability for material defects in the purchase contract. This is common practice when selling a car privately and means that private sellers are generally not liable for defects in the vehicle. Nevertheless, private sellers are liable for guarantees and fraudulently concealed defects. It is therefore also important how the condition of the vehicle is presented, for example in an ad on eBay/classifieds. If the buyer can prove fraudulent deception - for example hail damage or a manipulated speedometer - the customer can withdraw from the purchase. Proving fraud is often difficult. The water damage in the video would also have been a defect that had to be reported, and the seller would have had to inform the buyer if he knew about it. BUYING A MOTORHOME FROM A DEALER Buyers are legally entitled to a warranty from a dealer, even for a used motorhome. The purchase contract is subject to a statutory liability for material defects of two years. However, if a private individual buys a used motorhome from a business, the liability for material defects is usually reduced to one year in the contract. PITFALLS WHEN BUYING Experts recommend having a report drawn up before buying. The costs are worth it compared to the high purchase price of a motorhome. Reports are drawn up by specialized assessors or Dekra and TÜV. Because moisture is a problem with motorhomes, experts recommend an annual leak test. For new motorhomes, this is mandatory in order to maintain the guarantee. Buyers should ask about this, or have a moisture measurement taken before buying. The purchase contract should expressly confirm that the motorhome has no moisture damage. Verbal promises are not enough. Water damage can result in expensive repairs. Other important points that should be confirmed in the purchase contract include special equipment and no accidents. WHERE CAN YOU PARK AND STAY OVERNIGHT IN A MOTORHOME? There are no uniform regulations governing overnight stays in motorhomes. Overnight stays are definitely more than just parking, so other regulations must be observed. One-off overnight stays to "restore driving ability" are generally permitted. Authorities usually assume a period of ten hours. However, drivers are not allowed to set up their own homes or put up camping furniture. Any use of public parking spaces that goes beyond restoring one's own driving ability requires a special permit from the municipality. If drivers camp without authorization, the fines range from 10 to 2,500 euros, depending on the federal state. PARKING YOUR MOTORHOME FOR A LONGER PERIOD If you want to park your motorhome for a longer period of time - for example at home in a residential area - you can do so under certain conditions. The Road Traffic Regulations (StVO) allow parking on the side of the road or in parking lots. However, you are not allowed to block driveways and you are not allowed to park in narrow sections of the road. There must be enough space for wide vehicles to drive through: 2.55 meters, plus a safety distance of at least half a meter. However, unwanted parking of motorhomes or campers is often prohibited by traffic signs. Further restrictions apply to vehicles with a total weight of over 7.5 tons.
