In 2021, it became known that the data of 533 million Facebook users had been accessed. In Germany alone, six million users were affected. The perpetrators had uploaded computer-generated cell phone numbers to Facebook. With the help of a special function on Facebook, they managed to locate the Facebook profiles that matched the cell phone numbers. They accessed the data that was publicly visible there. One affected person had sued Meta, seeking compensation. He accuses Meta of not having adequately protected his data. Today, the Federal Court of Justice in Karlsruhe issued a user-friendly ruling. According to the BGH, the loss of control over the data is already damage. Those affected do not have to prove anything more - such as that the data was misused. First, however, the case goes back to the lower court - which has to examine whether compensation could be excluded because the user has agreed to Facebook's terms of use. Anyone affected can still sue Meta and demand compensation until the end of the year. The BGH today named around 100 euros as a guideline.
