In the last edition of the Plenary Sessions of the year, you will see that a request for review by Justice André Mendonça postponed until February the vote on the lawsuits that question the constitutionality of Article 19 of the Brazilian Civil Rights Framework for the Internet. In these lawsuits, the justices decide whether platforms must delete content posted by users without a court order. The trial began on November 27. Justices Dias Toffoli and Luiz Fux, rapporteurs of the appeals under analysis, voted. Both voted for the unconstitutionality of the article. The justice defended the need to regulate social networks from an economic perspective and protect copyright and data rights. The Plenary Sessions will also show that the Virtual Plenary Session of the Supreme Federal Court rejected an appeal by former President Jair Bolsonaro and kept Justice Alexandre de Moraes as rapporteur of a case investigating Bolsonaro's participation in the attempted coup d'état and abolition of the democratic rule of law. The Virtual Plenary confirmed the decision of the President of the Court, Justice Luís Roberto Barroso, who had rejected the former president's request in the proceedings investigating the anti-democratic acts of January 8th of last year.
