The Access to Information Law, also known as LAI, or Transparency Law, allows any person (natural or legal) to request information from public bodies or entities. The Law establishes as a fundamental principle that access to public information is the rule, and secrecy is the exception, only in specific situations. The Law defines the mechanisms, deadlines and procedures for the delivery of information requested to the public administration by citizens. It is up to public authorities and entities to ensure the transparent management of information. Any interested party may submit a request for access, and the request must contain the identification of the applicant and the specification of the information required. Regarding deadlines, if it is not possible for the requested body to have the data immediately, it will have up to 20 days to set a new return date for the consultation or indicate the reasons for refusing to release information. What cannot be disclosed under the transparency law is confidential information or personal information. What cannot be disclosed are hypotheses of secrecy provided for in other laws, such as, for example, tax secrecy, banking secrecy, judicial secrecy and industrial secrets. The law defines “confidential” information as information restricted to public access, temporarily, as it is essential to the security of society. Top secret, with a secrecy period of up to 25 years Secret, with a secrecy period of up to 15 years Reserved, with a secrecy period of up to 5 years. Information that could put the security of the President and Vice-President of the Republic and their respective spouses and children at risk will be classified as RESERVED and will remain confidential until the end of the current term of office, or the last term, in case of re-election. “Personal” information is information related to a natural, identified or identifiable person. Personal information relating to intimacy, private life, honor and image will have restricted access, regardless of secrecy classification, and for a maximum period of 100 years. Note that here, in this 100-year-old secrecy, the Law seeks to protect personal information, related to someone's private life, and not public order information. In situations where access to the requested information is denied, this denial must be duly substantiated.
