Abandonment of Public Office: what is it and what are the consequences? Abandonment of public office is one of the most serious disciplinary infractions that a public servant can commit. Abandonment of public office is characterized by the intentional absence of a public servant from work for more than 30 consecutive days. Abandonment of public office is investigated through an administrative disciplinary proceeding (PAD), which is a legal instrument that aims to determine the responsibility of a public servant for an infraction committed in the exercise of his/her duties or that is related to the duties of the position in which he/she is invested. To establish abandonment of public office, the PAD committee must prove that the public servant intended to be absent, and that it is not enough that he/she was absent from work. In other words, in addition to absences, which is the objective element of abandonment of public office, it is necessary to prove the animus abandonandi of the public servant, his/her intention to be absent from work.
