Japanese Buddhist statues" series, and it covers Buddhist statues made during the Asuka period from the 6th to 8th centuries. Japanese Buddhist statues from the Asuka period were created under the influence of the style of Buddhist statues made in mainland China and the Korean peninsula, shortly after Buddhist statues were introduced to Japan. This article covers the religious situation in Japan at the time of the creation of these Asuka period Buddhist statues, the style of expression of the statues, and the influence of statues from overseas. Therefore, the copyright protection period for all works has expired according to the provisions of Articles 51, 52, 53, and 57 of the Japanese Copyright Act, which guarantees copyright for 70 years after the death of the author. ☆Copyright of photographs of sculptures When a flat photograph of a painting or other flat sculpture is taken and a flat photograph is created, the photograph is not recognized as a copyrightable work because the originality of the photograph is not confirmed. On the other hand, photographs of three-dimensional sculptures are recognized as copyrightable works. Therefore, for three-dimensional works in the video, photographs of works from "Creative Commons", "Public Domain", and "Examples of works permitted for use on Colbase" are used, and the facts and forms of their use are clearly stated in the "explanation" of the video. ☆Rights of the Artwork Owner Under the Copyright Act, "After the copyright expires, the reproduction rights of the work held by the copyright owner are not restored to the owner, but the work reverts to the public domain, and anyone may freely use it as long as it does not harm the author's personal interests" (Reference: Supreme Court decision in the "Gan Zhenqing Self-written Letter of Independence" case (1984) cf. Case Collection Minshu Vol. 38, No. 1, p. 1). ☆Modification of materials The "moral rights of the author" (Article 60 of the Copyright Act) mentioned in the above case also includes the "right to maintain the integrity" (Article 20 of the same Act), which prohibits the modification of a work against the author's will, and the surviving family members who can claim this right are the author's spouse, children, parents, grandchildren, grandparents, and siblings (Article 116 of the same Act). In this regard, it is considered that there is almost no possibility that the rights holder is still alive as of 2021 for the materials featured in the video that were made more than 120 years ago after the death of the author.
