How does the world manage to provide a coordinated response to global phenomena that transcend national states, such as mass migration, pandemics, organised crime, illegal economies or ecological catastrophes? Beyond multilateral organisations, which are the focus of various criticisms, can there be other legal instruments that help prevent and confront very serious challenges that exceed the borders of States? What if the solution were a Constitution of the Earth? This proposal is being promoted by Dr. Luigi Ferrajoli, an Italian lawyer and former judge, who was a professor of Philosophy of Law and General Theory of Law at the University of Camerino, where he was also dean of the Facoltà di Giurisprudenza (Faculty of Law), and today is professor emeritus of Philosophy of Law at the University of Rome III. Ferrajoli is, moreover, one of the best-selling and most translated authors of legal literature in the world. This year he published his latest book, entitled “For a Constitution of the Earth”, where he bases his proposal but also offers an ordered text of one hundred articles as a basis for discussion. In this work, the jurist states that humanity is at the most “dramatic and decisive” crossroads in its history, since national institutions are not capable of responding to problems that put human survival at stake. To overcome this challenge, Ferrajoli proposes approving a Magna Carta on a planetary scale, which, among other things, protects vital natural resources, prohibits all weapons as illicit goods, and introduces institutions that guarantee the defense of human rights. We are going to delve deeper into this stirring idea with Dr. Ferrajoli himself, who today has been kind enough to meet us at his home in Rome. We are anticipating a colloquium that will take place tomorrow and in which, from Rome, Ferrajoli will present his book to the Uruguayan public.
